Introduction

The Yarnplayer application and any associated services (collectively, the "App") are made available to you by the developer of Yarnplayer ("we", "us", "our"). By accessing, downloading, or using the App, you agree to follow and abide by these Terms of Use ("Terms"). We may update these Terms from time to time without prior notice, and the most recent version will always be available here.

The App is not designed for children under 13 years of age. If you disagree with any part of these Terms, please do not use the App.

Your Content and Connected Services

Yarnplayer is a player for content you provide or have the right to access: audiobooks and audio files you import, podcasts you subscribe to, and media servers (such as Plex) that you connect. You are responsible for ensuring you have the right to use that content and for complying with the terms of any service you connect to the App. You agree not to use the App to infringe the intellectual property or other rights of any third party.

Ad Analysis & AI Features

Yarnplayer's Ad Analysis feature uses AI to identify likely sponsored segments within an episode.

• When you run it, the episode's transcript text is sent anonymously to an AI provider, as described in our Privacy Policy.
• AI-generated results are provided for convenience and may be incomplete or inaccurate. Segment boundaries and categories are estimates, not guarantees.
• By using this feature you acknowledge these limitations and agree that we are not responsible for inaccuracies.

Modification of Services

We reserve the right to modify or discontinue, temporarily or permanently, the App or any of its features without prior notice. You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App or any feature.

In-App Purchases and Subscriptions

The App offers an optional Pro upgrade that unlocks additional features, including Ad Analysis. All transactions are processed securely through Apple's App Store and are governed by Apple's applicable terms. Entitlement and subscription status are managed by RevenueCat, which does not receive personally identifiable information about you; see RevenueCat's Privacy Policy.

All purchases are final and subject to Apple's refund policies. You can manage or cancel a subscription at any time through your Apple Account settings.

Proprietary Rights

The App, including any software used in connection with it, contains proprietary and confidential information protected by applicable intellectual property laws. Except as expressly authorized by us, you agree not to modify, copy, distribute, reverse engineer, or create derivative works based on the App, in whole or in part. You are granted a personal, non-transferable, non-exclusive right to access and use the App. "Yarnplayer" and the Yarnplayer logo are trademarks of the developer and may not be used without prior written consent.

Disclaimer of Warranties

THE APP AND ITS CONTENT ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We make no warranty that the App will meet your requirements, be uninterrupted, timely, secure, or error-free, or that results obtained from it will be accurate or reliable.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE TO RELEASE US FROM ANY LIABILITY ARISING FROM YOUR USE OF THE APP. WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP, INCLUDING ANY LOSS OF DATA.

Indemnification

You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, arising out of your use of the App, your violation of these Terms, or your violation of any rights of another party.

Termination

We may terminate or suspend your access to the App, without prior notice, under certain circumstances, including your violation of these Terms.

Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located within Australia.

General

These Terms represent the entire agreement between you and us concerning your use of the App. If any provision is deemed invalid, the remaining provisions remain in full force and effect. You may not assign or transfer your rights under these Terms without our prior written consent.
